Gaming Laws in Nebraska

Illegal gambling in Nebraska is defined as “betting something of value upon the outcome of a future event which is determined by an element of chance” in State Statute 28-1101. All forms of gambling were deemed illegal according to the state constitution until 1934, when it was amended to permit parimutuel wagering on horse racing at licensed tracks. Bingo games were likewise permitted in another amendment to the constitution in 1958 while raffles, lotteries and other charitable gaming were later allowed in 1967. In 1988, simulcasting of horse races were permitted in yet another amendment to the state constitution.

The state prohibits the use of gambling devices like slot machines outside of tribal casinos.

Tribal Casinos

There are currently four tribal casinos in the state and two more owned by Nebraska tribes that are located in Iowa.
